This page tells you the Terms & Conditions on which you may make use of the dagnyd.co.uk website (the “Site”), and the terms applicable to the sale of goods or services through the Site.

By using the Site you agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions then please refrain from using the Site and do not place any orders using the Site.

About us

The Site is operated by Dagny Denison, a Sole Trader trading as dagny.d (“I” or “we”).

Accessing our site

Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Site without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period.

Contract

Each order you place shall be deemed to be an offer by you to purchase the goods and/or services specified within it subject to these Terms & Conditions. The contract will relate only to those goods and/or services notified in the email acknowledgement of order. All orders are subject to acceptance and product availability.

Payment methods

Purchases may be paid for by using a debit or credit card through PayPal, our online payment facility. This means that no credit or debit card details are held by us or on our server. Don’t worry if you don’t have a PayPal account, you can still pay with your credit card and check as a guest without having to sign up for an account with PayPal.

Prices & Taxes

All prices are in pounds sterling (£), and are payable in pounds sterling (£). Currently I am not obliged by law to charge VAT, and therefore prices on the Site do not include, and are not subject to, VAT.

This may change at any time in the future.

Postage and packaging prices are charges separately, and are shown clearly on the website.

Import regulations and duty

If you order goods from our Site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Refusal of transaction

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.

We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

No waiver by us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability

If any of these Terms & Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Entire agreement

These Terms & Conditions and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

Force majeur

Where we are prevented from or delayed in the carrying on of our business due to circumstances beyond our reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials the date of delivery shall be postponed for the period that the circumstances continue.

Liability

We do not accept liability for any errors and/or omissions contained in our Site and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.

The products sold on dagnyd.co.uk are intended for personal domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from dagnyd.co.uk

Law and jurisdiction

Contracts for the purchase of Goods through our website will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
